Terms of Service

These terms govern your use of the Xfinity Motors website and set out the basis on which we advertise vehicles. Separate written terms apply to the sale itself and are provided before you commit to a purchase.

1. Using this website

You may browse, save and print listings for your own use. You may not scrape, republish or systematically extract our listings, photographs or descriptions; use the site to send unsolicited commercial messages; attempt to gain unauthorised access to any part of it; or introduce anything designed to disrupt it.

We may suspend access to the site, or to any part of it, without notice where we reasonably believe it is being misused.

2. Listings are an invitation to treat

A listing on this site is an invitation to make an offer, not an offer capable of acceptance. No contract of sale exists until we have accepted your offer in writing and taken payment or a deposit.

We try hard to keep listings accurate, but specifications, equipment and availability can change and errors happen. Where a listing contains a material error — including an obvious pricing error — we may correct it or withdraw the vehicle, and we will tell you promptly if it affects a vehicle you have enquired about or reserved. If you have already paid a deposit against a withdrawn vehicle, the deposit is refunded in full.

Mileage, service history and condition information is provided in good faith on the basis of documentation, the DVSA MOT record and our own inspection. Vehicle history data is supplied by third parties and we are not responsible for errors within it, though we will help you resolve any discrepancy.

3. Enquiries and reservations

Enquiry forms and WhatsApp messages are monitored during opening hours. We aim to respond within one working day, but a response is not a commitment to sell.

A reservation deposit holds a vehicle for seven days and is fully refundable if you do not proceed. It is applied to the purchase price if you do. Reserving a vehicle does not fix its price beyond the reservation period.

4. Pricing

Advertised prices are in pounds sterling, include VAT where it applies, and include documentation and preparation charges. They exclude road tax (VED) and the DVLA transfer, and any delivery charge, both of which are quoted separately before you commit. Commercial vehicles advertised "plus VAT" are marked as such on the listing.

5. Finance

Where we introduce you to a finance provider we act as a credit broker, not a lender. Xfinity Motors Ltd is authorised and regulated by the Financial Conduct Authority for consumer credit broking. We may receive a commission from the lender, the nature and existence of which will be disclosed to you before you sign. Any credit agreement is between you and the lender, and their terms govern it.

6. Intellectual property

All content on this site — text, photographs, descriptions, layout and code — belongs to Xfinity Motors or our licensors. Manufacturer names, model names and logos are the trademarks of their respective owners and appear here solely to identify the vehicles we sell.

7. Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, the website is provided "as is". We do not warrant that it will be uninterrupted or error-free, and we are not liable for indirect or consequential loss, loss of profit, or loss arising from your reliance on information on the site that we have not confirmed to you in writing.

Your statutory rights as a consumer under the Consumer Rights Act 2015 — that a vehicle must be of satisfactory quality, fit for purpose and as described — are unaffected by these terms and cannot be excluded.

8. Third-party links

Where we link to a third-party site — a finance provider, a manufacturer, a mapping service — we do not control it and are not responsible for its content or its privacy practices.

9. Changes

We may amend these terms. The version in force is the one published here at the time you use the site. Material changes will be flagged on this page.

10. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that if you are a consumer resident in Scotland or Northern Ireland you may bring proceedings in your own jurisdiction and the law of that jurisdiction applies.
